What is a Definitive Map and Statement?
The
Definitive Map and Statement is a two part document held by the
Highway Authority for rights of way. The map shows all known rights
of way in the County. The statement describes the route of the
path and may contain details of the width of the path, any restrictions
and information about legal orders that may have affected the
alignment of the path.
Where can I see a Definitive Map and
Statement?
The Surveying Authority (Cumbria County Council)
for rights of way has a duty to make this document available for
public inspection. Certified copies may be deposited with local
libraries, councils (district and parish). If you ring and make
an appointment you will be able to see the document. However,
you may be charged if you require a photo copy.
The Definitive Map
is prepared and kept by the Highway Authority to record
public rights of way up to BOAT status (they keep separate maps
for public roads) and it is conclusive evidence of the existence
of a particular point in time (called Relevant Date) of the right
of way and its recorded status. However, this is without prejudice
to the possible existence of other, higher rights but these would
have to be proved to the satisfaction of the Authority. Similarly,
a way not recorded on the Definitive Map may be a public right
of way but again, proof of public status is required.
